McCain does 180 on immigration

As John McCain sees his chances for the White House dropping like a lead balloon, he has changed his views on illegal immigration. Backing away from the recent failed immigration bill which McCain stood behind in spite of the Conservative base, he is now sponsoring “a scaled-down proposal that imposes strict rules to end illegal immigration but doesn’t include a path to citizenship.”

“We can still show the American people that we are serious about securing our nation’s border,” McCain said in a statement, adding that the new bill would “provide an essential step toward achieving comprehensive reform in the future.”McCain’s immigration position has been a campaign liability among Republican voters and hurt his efforts to raise money. Other GOP presidential candidates, fellow Arizona Republicans and immigration opponents throughout the country have loudly decried his position.

Observers said McCain’s switch was political. “He recognizes his position on the issue is killing him,” said Steven Camarota, research director at the Center for Immigration Studies, which favors vigorous immigration enforcement.

McCain’s co-sponsors include Republican Sens. Lindsey Graham of South Carolina and Jon Kyl of Arizona. All three were leading advocates for the unsuccessful comprehensive immigration measure and were bombarded with criticism for their support.

Immigrants’ rights advocates jumped to condemn their decision. (more)

Quarter Ton of Marijuana Equals Free Pass – But Only If You Are An Illegal Alien…

3 08 2007

Cross posted from Common Sense America

Just when you thought our government couldn’t get sink any lower in the dereliction of their duty to protect this nation and uphold our laws, you get an e-mail from a reader with a link to this…

From ABC News via a link from Ms. ZH:

If you’re caught with two pounds of pot that you plan to sell, plan on going to jail for up to seven years.

With 500 pounds, you can kiss your completely freedom goodbye.

But head down to Southern Arizona, near the border, do the exact same thing, and in many cases you get off scott-free.

No prosecution, no penalty, no prison…in fact – not even a slap on the hand.

County prosecutors say it’s enormously frustrating and for the drug cartels, enormously profitable.

But this sweet deal only applies if you’re illegal and smuggling 500-pounds or less.

And therein lies one of our country’s dirty little secrets: Mexican drug runners getting a free pass back to Mexico if they’re caught with less than a quarter-ton of pot.

Cochise County attorney Ed Rheinheimer spells it out. “If a seizure is made of an amount less than 500 pounds, the case doesn’t get prosecuted.”

You read that right.

Drug runners doing business without punishment.

But don’t blame the county attorneys.

Remember: These are federal cases and should be federally prosecuted.

But guess what?

They don’t get prosecuted by the feds and now, they don’t get prosecuted by guys like Ed Rheinheimer, either.

“Since 2003 we stopped prosecuting federal referrals because of a lack of resources.” [snip]

And while these “weight limits” are unfamiliar to most Americans – drug cartels know them well and plan accordingly.

Sergeant Terry Parish warehouses the seizures. We walked through store rooms holding marijuana from floor to ceiling.

Lisa Fletcher: “How many of these guys do you think are aware of this sort of unspoken rule that if you’ve got less than 500 pounds, you’re probably not going to get prosecuted?”

“I think probably more of them are aware of it than individual officers are. Their intelligence is very good, it’s what they do for a living.”

And they do it every night…all along Arizona’s border.

War on drugs? Don’t make me laugh. This a full frontal assault on the American citizen and our society. Think I’m wrong? Well, consider this, it seems George Orwell’s famous quote, “All animals are equal, but some animals are more equal than others” has never been more accurate than it is in America today.

Is it any wonder Americans are outraged over the current illegal immigration situation? While our government winks and nods at Mexico, we’ve watched as illegal immigrants are afforded more and more rights in our society than American citizens – American citizens who happen to get stuck with the bill to pay for all of this generosity and are hauled off to prison if we dare to think of breaking any of the laws that illegal aliens receive a free pass for breaking.

Our rewards for being Americans and legal American citizens are higher taxes, higher crime rates, lower wages, higher insurance premiums and on and on while illegal aliens are rewarded for their crimes against our borders and our society with:

Free health care – U.S. taxpayers pay the medical bills for illegal aliens yet the cost of most American’s monthly health insurance premium for even a small family has now exceeded their monthly mortgage payment and if we fail to pay for our insurance and need medical care, our home will have to be sold to cover the costs.

The right to be above the law – Illegal aliens can hide in ’sanctuary cities’ that say, “we care more about the rights of criminal aliens than the rights of our own citizens” yet American criminals are not afforded a place to hide, in fact, they are hunted down.

In-state tuition – Senators Hillary Clinton, Dick Durbin, and other members of our Congress are proud sponsors of the illegal dream yet American children have to pay more for their college tuition than their illegal counterparts as some states have already implemented in-state tuition for illegal aliens in direct violation of our federal law.

Day laborer centers – American taxpayers fund illegal day laborer centers yet there are no ‘gathering places’ being built for unemployed American workers.

No ID necessary – “The stigma and humiliation of constantly proving lawful status is unacceptable”, says the ACLU yet Americans are expected to show 2 forms of verifiable ID to obtain a driver’s license.

Fair share of Katrina disaster aid – Hillary Clinton – defender of the illegal alien, made sure that illegal aliens got their ‘fair share’ of the Katrina disaster aid paid for courtesy the American taxpayer.

Using our courts to see that crime pays – 2 illegal immigrants won an Arizona ranch in court. Do you think an American trespasser could get that lucky in court?

Turning our sense of right and wrong on its head – The Minuteman Project and other anti-illegal immigration groups are targeted as bands of racists and even called ‘vigilantes’ by our President and ‘bigots’ by a member of the U.S. Senate. Americans who are trying to help the border patrol, because of our government’s total disregard for the citizens of this nation, are rewarded by being vilified by the very officials failing to live up to the office they occupy. In this topsy-turvy world, criminals are now accepted as the victim and law-abiding citizens are handed the bill and openly accused of racism if they disagree. Or arrested if they dare to protest.

Our Border Patrol agents languish in prisons while known drug smugglers are given immunity.

And now, American citizens can expect to face prison time for small amounts of marijuana while illegal aliens can possess a quarter of a ton – and bring it across an international border – with absolutely no ramifications?

Orwell was right, “Some animals (and people) ARE more equal than others”.

Republicans walk out over Democrats proceedural violation

3 08 2007

In a massive flare-up of partisan tensions, Republicans walked out on a House vote late Thursday night to protest an unpresidented violation of House rules to reverse an unfavorable outcome for them on a procedural motion designed to bar undocumented immigrants from receiving any federal funds apportioned in the agricultural spending bill for employment or rental assistance

The flap represents a complete breakdown in parliamentary procedure and an unprecedented low for the sometimes bitterly divided chamber.

One GOP aide saw McNulty gavel the vote to a close after receiving a signal from his leaders – but before reading the official tally. And votes continued to shift even after he closed the roll call They believed it was a tie of 214 to 214, but it turns out that they lost 215-213. Democrats, however, argued the measure was deadlocked at 214-214 and failed.

So, Majority Leader Steny H. Hoyer, D-Md., eventually offered a motion to reconsider re-opening the vote.twisting arms to get some democrats to change their votes to prevail on a 216-212 tally. But the maneuver sparked a chorus of angry protests from the Republicans, yelling “shame” on Democrats and the Republicans walked out in masse.

The House eventually recessed at 11:18 p.m. But Republicans quickly discovered that there was no longer any record of the controversial vote and immediately charged Democrats with erasing the bad result.

Dope dealer in Ramos-Compean case cops guilty plea

3 08 2007

Sutton’s bargain with smuggler’s accomplice keeps key evidence sealed

From WND:

Sutton also has refused to answer whether his office has extended the prosecutor’s immunity deal with Aldrete-Davila to include any subsequent drug offenses that may have involved Ortiz-Hernandez.

WND reported Prosecutor Debra Kanof argued at the Ramos-Compean trial that presiding U.S. District Judge Kathleen Cardone should seal any discussion of Aldrete-Davila’s involvement in the second load involving Ortiz-Hernandez from the jury.

Cardone ruled not only that defense attorneys were prohibited from revealing any information about Aldrete-Davila’s second load to the jury but that defense attorneys and the family of Ramos and Compean would be prosecuted for violating the judicial seal should they reveal to the press any hint of Aldrete-Davila’s involvement.

As WND reported, Rohrabacher revealed in a July 25 press conference the six unconditional, unescorted border pass cards the DHS issued Aldrete-Davila at the request of Sutton’s office.

The border pass cards were issued to Aldrete-Davila over a one-year period starting March 2005, with the final border pass card issued in January 2006, three months after the October 2005 second load incident involving Aldrete-Davila with Ortiz-Hernandez.

Aldrete-Davila’s last DHS border pass card expired March 31, 2006, fully three months after the Ramos-Compean trial had ended and five months after the second load incident.

At the Ramos-Compean trial, Sutton and Kanof allowed Davila to present sworn testimony on the stand that he was an inexperienced drug smuggler who only committed this one offense because his commercial driver’s license in Mexico had expired and he needed money, supposedly to buy medicine for his sick mother.

Aldrete-Davila’s testimony at trial was critical to the prosecution, because Aldrete-Davila was the only person who could testify he was unarmed during the initial Feb. 17, 2005, incident with Ramos and Compean at the border.

Ramos and Compean testified they believe Aldrete-Davila reached back at them with what they thought was a gun as the smuggler fled across the Rio Grande back to Mexico after he abandoned the drug van in the Feb. 17, 2005, incident.

Defense attorneys were prohibited by Judge Cardone’s ruling from using any information about Davila’s second drug load to impeach the credibility of Aldrete-Davila’s testimony at trial.

Medical reports obtained by WND document that Aldrete-Davila was wounded in the left side of his left buttocks. The bullet traversed his groin and lodged in his right thigh.

At the trial, the U.S. Army doctor who removed the bullet testified Aldrete-Davila’s wound was consistent with a “bladed movement,” with Davila reaching his left hand back toward the officers as he was running away.

The doctor’s testimony about the wound was consistent with Ramos’ and Compean’s belief Davila reached back with a gun while escaping.

As I have reported on my radio show, he was NOT shot in the back as Johnny Sutton keeps claiming on every news show he appears on.

“Sutton and Kanof allowed Davila to present sworn testimony on the stand that he was an inexperienced drug smuggler who only committed this one offense because his commercial driver’s license in Mexico had expired and he needed money, supposedly to buy medicine for his sick mother.”

This alone shows this was a railroad conviction. They knew about the second load of drugs and he has stated on the Glenn Beck show that he know Davilla is part of a cartel and this is an ongoing investigation, which is why he cannot release certain details. On top of that the Judge KNEW about the second drug bust and ruled it sealed!!

Now…

Cipriano Ortiz-Hernandez, the stash house operator in the “second load” brought across the border by Osbaldo Aldrete-Davila in the Ramos and Compean case, pleaded guilty in El Paso to drug charges.

WND has obtained copies of a signed guilty plea entered Tuesday with the U.S. District Court for the Western District of Texas in El Paso by Ortiz-Hernandez admitting he conspired to possess with the intent to distribute 2,200 pounds or more of marijuana in violation of federal drug statutes.

The plea bargain allows prosecuting U.S. Attorney Johnny Sutton to continue withholding government investigative reports implicating Aldrete-Davila with a “second load” drug incident involving Ortiz-Hernandez.

Had Ortiz-Hernandez sought a trial, his defense attorneys would have demanded release of Department of Homeland Security and Drug Enforcement Administration reports naming Aldrete-Davila as a perpetrator in at least one drug incident for which Ortiz-Hernandez has pleaded guilty.
